General Terms and Conditions for the Zollverein Ice Rink Ticket Shop
of Zollverein Foundation
1 Scope of Application
1.1 The following General Terms and Conditions apply to any online purchase of:
- Admission tickets for the Zollverein Ice Rink
- Admission tickets for the Ice Disco
- Tickets for Ice Stock Sport
organised and/or conducted by Zollverein Foundation (hereinafter referred to as "Foundation").
1.2 By submitting an offer to purchase ticket online (see Section 2.2, Sentence 2), the buyer agrees to the general terms and conditions of the Foundation as stated below. The buyer acknowledges that their own general terms and conditions, which deviate from or supplement the following general terms and conditions, are not part of the agreement. This also applies if the Foundation does not explicitly object to them.
2 Conclusion of Contract
2.1 The contract is concluded through an offer made by the customer and its acceptance by the Foundation.
2.2 The provision of the ticket shop and the offers communicated therein for the Zollverein Ice Rink, Ice Disco, and Ice Stock Sport, as well as the provision of an online ordering system by the Foundation, merely constitute an invitation for the buyer to submit an offer and do not represent an offer in themselves. The customer’s offer is submitted by sending their ticket order after selecting the payment method and clicking the “OK” icon. The offer is deemed received when the order reaches the server hosting the Foundation’s incoming orders.
2.3 Acceptance of the offer is effected by the Foundation sending a confirmation e-mail to the buyer. The acceptance is considered received once the e-mail arrives on the inbox server (e-mail server) hosting the buyer’s e-mails.
2.4 The confirmation e-mail includes a digital version of the ticket in PDF format as an attachment.
3 Obligations of the Foundation
3.1 The Foundation is obligated to send the buyer a digital ticket in PDF format, which contains the following information:
- Name of the ordered admission tickets for the Zollverein Ice Rink, Ice Disco, and Ice Stock Sport
- Number of persons permitted entry and, if applicable, relevant criteria for pricing (adults, discounts, children, etc.)
- Validity period and, if applicable, a specific time
- Barcode confirming the successful payment of the tickets
3.2 The Foundation is obligated to allow one-time admission to the ice rink or ice stock sport area for the person(s) presenting a fully legible ticket as specified in Section 3.1 upon admission. If multiple printed copies of a digital ticket in accordance with Section 3.1 exist, the Foundation is only required to grant admission to the first person(s) presenting a fully legible ticket at the point of entry.
The Foundation has no obligation to grant admission or participation without the presentation of a fully legible ticket as described in Section 3.1, even if a valid purchase contract has been concluded under Section 2 and the buyer has fulfilled their payment obligation according to Section 4.1.
The Foundation is not required to replace any lost ticket after the confirmation e-mail, including its attachment, has been sent (Sections 2.3/2.4).
The admission ticket loses its validity upon entry to the Zollverein Ice Rink or ice stock sport area, or upon validation. Day tickets are non-transferable once admission has been granted. Tickets that have been falsified or otherwise manipulated do not grant admission and will be confiscated by the Foundation without replacement or compensation. The same applies in cases of ticket misuse.
The Foundation reserves the right to fully or partially close areas around the Zollverein Ice Rink or restrict access to them. Such closures or access restrictions do not give rise to any claims from visitors.
3.3 The content of the offers for the Zollverein Ice Rink, Ice Disco, and Ice Stock Sport is solely determined by the Foundation. If the Foundation deems it necessary to change the content for practical or other reasons, it may do so at any time. By granting access to or facilitating participation in these modified offers, the Foundation fulfils its contractual obligations.
3.4 The Foundation is not obligated to wait for latecomers holding online tickets.
- Time slots begin punctually at the time indicated on the ticket. The Foundation is not required to admit a latecomer to an already commenced time slot or to extend the time slot.
4 Obligations of the Buyer
4.1 The buyer is obligated to pay the purchase price for the ordered tickets. Payment is due immediately and is considered paid once the payment has been received in the Foundation’s bank account.
4.2 The buyer is responsible for ensuring that they have the necessary technical requirements to display and print the digital version of the ticket. These requirements include:
- Availability of a PDF reader
- Use of white paper in A4/letter format
- Printing in original size (100%)
- A smartphone or tablet for mobile ticketing
4.3 The buyer must ensure that the barcode on the ticket provided in accordance with Section 3.1 remains legible upon entry to the Zollverein Ice Rink, the Ice Disco, or the ice stock sport area. In particular, they must prevent any kind of dirt or damage to the barcode and ensure a clear printout.
4.4 The buyer is prohibited from reselling tickets provided as per Section 3.1 and must store them securely, like cash or traditional admission tickets, to prevent misuse.
4.5 The buyer is obligated to immediately verify the accuracy of the information on their ticket, as specified in Section 3.1, upon receiving the confirmation e-mail (Section 2.3). Any discrepancies from their order must be reported to the Foundation within 48 hours after receiving the confirmation e-mail. If the Foundation does not receive a complaint within this period, the ticket’s contents are considered contractually agreed upon.
4.6 The buyer acknowledges that the premises of the former Zollverein Coal Mine and Coking Plant, as well as the adjacent areas and buildings on the premises, are former industrial facilities and sites. Therefore, entering these premises requires appropriate clothing and footwear, as well as appropriate behaviour. The buyer commits to wearing suitable footwear and appropriate clothing, as well as behaving in a manner that reduces the risk of injury or damage to any personal belongings.
The house rules of Zollverein Foundation apply.
5 Right of Withdrawal / Cancellation / Refund
5.1 The Foundation is entitled to withdraw from a contract for the use of the Zollverein Ice Rink area or the ice stock sport area if weather conditions only allow the execution of an offer with increased risk for participants and/or in other cases where the performance of the service is impossible, in cases of force majeure, and/or in cases of obvious pricing errors.
The Foundation is entitled to withdraw from a concluded contract in cases of force majeure.
Under no circumstances is the Foundation obligated to provide further compensation.
5.2 The buyer has no general right to return, rebook, or exchange tickets. As services in the leisure sector with a fixed service date—particularly the sale of event admission tickets—do not constitute a distance selling transaction according to Section 312b (3) No. 6 BGB, there is no right of withdrawal or return.
5.3 The Foundation explicitly points out that the premises of the former Zollverein Coal Mine and Coking Plant, as well as the adjacent areas and buildings, are former industrial sites. A withdrawal is not justified in cases where a ticket buyer realises on site that their clothing or footwear is unsuitable for participation in the offers.
5.4 The buyer has no right to a refund or reversal of the purchase contract if they do not carry a fully legible ticket in accordance with Section 3.1 on the day of the visit and are therefore denied access to the Zollverein Ice Rink. The Ice Disco, or the ice stock sport areas.
6 Commercial Rights and Copyrights
6.1 The content of the ticket shop's website, as well as the underlying software, is protected by copyright. Company names, logos, and/or product names mentioned on the website may be protected as commercial property rights.
6.2 The Foundation expressly reserves all rights to which it is entitled under statutory provisions. This particularly applies to the unauthorised use of texts, images, and the design of the ticket shop's website. Any use not explicitly permitted in these General Terms and Conditions requires the prior, express, and written consent of the Foundation.
7 Disclaimer of Warranty and Limitation of Liability
7.1 Warranty or liability claims based on personal taste or dissatisfaction with the Zollverein Ice Rink, the Ice Disco, or the ice stock sport areas, or any digital offer are excluded.
7.2 The Foundation is only liable for intentional misconduct and gross negligence. This limitation does not apply to liability for damages resulting from injury to life, body, or health.
In this regard, the buyer acknowledges that the premises of the former Zollverein Coal Mine and Coking Plant, including adjacent areas and the buildings located on the site, are former industrial facilities. Entering these premises is at the buyer’s own risk. The Foundation is not liable for damages caused by the buyer’s behaviour that contradicts their obligations as outlined in Section 4.6.
7.3 The Foundation is only liable for breaches of duty by its agents and vicarious agents if they are based on intent or gross negligence. This limitation does not apply to liability for damages resulting from injury to life, body, or health. The provision in Section 7.2, Paragraph 2 applies accordingly.
7.4 Claims by the customer against the Foundation due to deficiencies in performance or any other breach of duty by the Foundation expire after one year.
8 Data Protection
Data protection information in accordance with Section 13 TMG is available under the section "Privacy Policy."
9 Place of Performance and Jurisdiction
9.1 The sole place of performance for delivery, service, and payment is Essen, provided that the customer is an entrepreneur within the meaning of Section 14 BGB.
9.2 If the customer is a merchant, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Essen. However, the Foundation is also entitled to file a lawsuit at the customer’s place of residence.
9.3 In the case of a contract with a consumer, the place of jurisdiction is Essen if the customer relocates their residence or habitual place of stay outside the jurisdiction of the Federal Republic of Germany after the contract has been concluded. This also applies if the residence or habitual place of stay of the customer is unknown at the time of filing the lawsuit.
9.4 For cross-border contracts, Essen, Federal Republic of Germany, is agreed as the exclusive place of jurisdiction for all disputes arising from the contractual relationship (Article 17 of the European Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters of September 27, 1968, EuGVU). However, the Foundation is entitled to bring an action before any other court that has jurisdiction under the EuGVU of September 27, 1968.
10 Final Provisions
10.1 The law of the Federal Republic of Germany shall apply exclusively. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
10.2 Should individual clauses of these General Terms and Conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining clauses or the remaining parts of these clauses. The parties shall replace the invalid provision with a valid provision that most closely reflects the intended economic and practical purpose.
